Protecting the MARTINI Trademark in a Cross-Border Infringement Case

AMBASSADORS represents BACARDI, the owner of the globally recognised MARTINI trademark, in a significant trademark infringement case involving the unauthorised import and distribution of MARTINI-branded alcoholic beverages produced abroad without the rights holder’s consent.

This case required a strategically coordinated legal response and the client's business interests to address infringement originating in the EU and manifesting in Ukraine, where unauthorised goods entered the market. A key challenge in the proceedings was the opposing argument that "Martini" is a generic cocktail name and, therefore, not protected under trademark law. AMBASSADORS successfully countered this position by relying on established legal practices during the pre-trial stage and resolving the conflict amicably.

This project highlights the importance of active brand enforcement across borders, particularly in the alcoholic beverages sector, where reputation, exclusivity, and market control are crucial for commercial success. Our efforts ensured that BACARDI’s rights remained intact and that the MARTINI brand was protected from dilution and unlawful exploitation.
